Districts and charters must ensure that the rights of children with disabilities and their families are protected.<\/p>\n<p>The federal Office of Special Education Programs (OSEP) is responsible for ensuring states&#8217; compliance with IDEA. OSEP has developed a continuous improvement monitoring process that includes compliance and fiscal oversight.<\/p>\n<div>\n<p>The Delaware Department of Education&#8217;s Exceptional Children Resources workgroup has the responsibility of assisting districts, charters, educational service agencies, and public agencies as they provide for the education of all students with disabilities by:<\/p>\n<ul>\n<li>Assessing the effectiveness of efforts to educate children with disabilities, and<\/li>\n<li>Ensuring compliance with state and federal laws concerning the education of children with disabilities. (Authority: <a href=\"https:\/\/www.govinfo.gov\/app\/details\/USCODE-2011-title20\/USCODE-2011-title20-chap33-subchapI-sec1400\"> 20 U.S.C. 1400(d) <\/a> ; <a href=\"https:\/\/delcode.delaware.gov\/title14\/c031\/sc02\/index.html\"> 14 Del.C. \u00a73110 <\/a> ; <a href=\"http:\/\/regulations.delaware.gov\/register\/june2007\/final\/10%20DE%20Reg%201816%2006-01-07.htm\"> 10 DE Reg. 1816 <\/a> )<\/li>\n<\/ul>\n<p>In addition, the workgroup provides grant and funding information to support districts and charters in supporting this mission.<\/p>\n<\/div>\n<div><img decoding=\"async\" style=\"width: px;height: px\" title=\"Students looking at school work\" src=\"https:\/\/education.delaware.gov\/legacy\/wp-content\/uploads\/sites\/4\/2024\/05\/19293524.jpg\" alt=\"Students looking at school work\" data-height=\"\" data-width=\"\" \/><\/div>\n<div>\n<h2>How is your district or charter performing in special education?<\/h2>\n<p><a href=\"https:\/\/education.delaware.gov\/legacy\/page\/3829\">State, District and Charter Performance Plan and Annual Performance Reports<\/a><\/p>\n<\/div>\n<div>\n<h2>Compliance Monitoring<\/h2>\n<p>Compliance Monitoring is a process at the local level to ensure that districts and charters are following the federal IDEA and all State of Delaware requirements regarding students with disabilities. Administrative responsibilities include the general supervision requirements of the IDEA, as well as program and fiscal monitoring and support for subrecipients as required by federal and state statutes and regulations. These policies and procedures ensure the oversight, evaluation, and monitoring of each Delaware Local Education Agency (LEA) and any other subrecipient.<\/p>\n<h2>Time and Effort<\/h2>\n<ul>\n<li>Proper documentation is on file for federally funded staff:\n<ul>\n<li>Internal controls include written policies\/procedures for accurately documenting compensation and fringe benefits paid with federal funds<\/li>\n<li>Required documentation is maintained for all employees compensated with Federal funds.
